Privacy Policy

The short version. To play Madstackz you give us an email address or a phone number, your date of birth, and the state you live in. We use them to run the game, to check you are old enough to enter, and to pay you if you win. We do not sell your personal information, we do not share it for advertising, and we do not run any analytics or advertising trackers — there are none in our app or on this website. This summary is for convenience; the detail is below.

1. Who this covers

This policy explains how Madstackz, Inc., a Florida corporation (“Madstackz,” “we,” “us”) handles personal information in the Madstackz game, our websites at madstackz.io and play.madstackz.io, and our mobile applications (the “Service”). It forms part of our Terms of Service.

The Service is offered only in the United States and is intended only for adults. See Section 10.

2. What we collect

What you give us

An email address or a phone number. This is how you sign in — there is no password.
Your date of birth and your state of residence, collected once, before your first game, so we can confirm you meet the minimum age where you live.
That you accepted the Terms, and which version, and when.
A username, if you set one, and a promo code, if you enter one.
Anything you write to us at our support address.
Tax details — if you win a prize of $600 or more in a year we will need a completed Form W-9, which includes your legal name, address and taxpayer identification number.

What the Service records as you play

Your playlist, trades, boosters, scores and contest results.
The in-game wallet we create for you and the in-game items it holds.
If you arrived through a link that identifies a channel or community, the identifier in that link.
Ordinary server records: IP address, browser or device type, and the time of each request. These are produced by our hosting provider and are used for security and debugging.

What we store on your device

A sign-in token that keeps you logged in, and the channel identifier described above. These are held in your browser's local storage, not in advertising cookies, and clearing your browser data removes them. We set no advertising or analytics cookies of any kind.

What we do not collect

We do not collect precise location, contacts, photos, microphone or camera data, or advertising identifiers. We do not run analytics, attribution or advertising software in the app or on this website.

3. Your in-game wallet

Your songs and boosters are held in an in-game wallet that we create for you when you first sign in. We generate and store that wallet's credentials on our servers so that you never have to manage them, and we treat them with the same protection as any other sensitive record. As explained in the Terms, in-game items have no cash value, cannot leave the Service, and are not transferable.

4. Why we use it

To run the game — build playlists, price trades, score contests, show results.
To confirm you are eligible: old enough for your state, in a permitted jurisdiction, and holding one account only.
To contact you about your account, a contest, or a prize you have won.
To pay prizes and to meet our tax reporting obligations.
To detect and prevent fraud, collusion, multiple accounts and abuse.
To keep the Service secure, diagnose faults, and correct scoring errors.
To comply with the law and to enforce our Terms.

5. Who we share it with

We do not sell personal information, and we do not share it for cross-context behavioural advertising. We share it only:

With the providers who run the Service for us: Magic, which handles sign-in and sends your login code; and Microsoft Azure, which hosts our applications and databases. They may only use what they receive to provide their service to us.
With tax authorities, where we are required to report a prize payment.
Where the law requires it — in response to a subpoena, court order or lawful request, or to protect the rights, safety or property of Madstackz, our players or the public.
With a buyer, if Madstackz is ever merged with or acquired by another company, in which case this policy continues to apply until you are told otherwise.
Publicly, in a winners list — first name, last initial and state only, where a contest's rules say so or the law requires it.

6. Messages we send

When you sign in, we send a one-time login code to the email address or phone number you gave us. If you sign in by phone, that is one message per sign-in attempt; message and data rates may apply, and you can reply STOP to any message to stop receiving them — though you will then need to sign in by email instead. We will also contact you directly if you win a prize or if there is something you need to know about your account.

7. How long we keep it

We keep your account information for as long as your account is open. If you close your account we delete your personal information within 30 days, except where we must keep something longer: prize payment and tax records are kept for seven years, and we may keep the minimum needed to enforce a suspension, resolve a dispute, or meet a legal obligation. Server logs are kept for up to 90 days.

8. How we protect it

Traffic between your device and our servers is encrypted in transit, access to production data is restricted to the people who need it, and sensitive records such as wallet credentials are handled separately from the data returned to the app. No system is perfectly secure, and we cannot guarantee that a determined attacker will never succeed — if a breach affects your personal information we will notify you as the law requires.

9. Your choices and your rights

Whatever state you live in, you may ask us to:

tell you what personal information we hold about you, and give you a copy;
correct anything that is wrong;
delete your account and your personal information, subject to the retention rules in Section 7; and
stop sending you messages that are not required to operate your account.

Email privacy@madstackz.io from the address on your account, or tell us the phone number you sign in with, and we will respond within 45 days. We will not treat you differently for exercising any of these rights.

California residents. In the last 12 months we have collected the categories described in Section 2: identifiers, age, commercial information about your play, internet activity in the form of server logs, and — for prize winners only — tax identifiers. We collected them for the purposes in Section 4 and disclosed them only to the recipients in Section 5. We have not sold or shared personal information, and we do not use or disclose sensitive personal information for any purpose that would give you a right to limit it. You may exercise the rights above, including through an authorised agent.

Residents of Virginia, Colorado, Connecticut, Texas, Oregon, Montana and other states with comprehensive privacy laws. The same rights apply, and you may also appeal a decision we make about a request by replying to our response; if we deny your appeal you may complain to your state attorney general. We do not use your information for targeted advertising, sell it, or profile you in a way that produces legal or similarly significant effects.

10. Children

Madstackz is for adults. You must be at least 18, or 19 in Alabama and Nebraska, and we ask for a date of birth before your first game to check. The Service is not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a minor has given us information, write to privacy@madstackz.io and we will delete the account and the information.

11. Changes to this policy

If we change this policy we will update the date at the top, and if the change is material we will tell you in the app or by email before it takes effect.
